Mr. Rosenberg’s practice at Slover & Loftus LLP encompasses a range of matters centering on energy and transportation.
In the transportation areas, Mr. Rosenberg has represented shippers in rate cases and other matters before the Surface Transportation Board, including proceedings resulting in significant modifications of the Board’s methodologies for calculating the cost-of-capital and productivity for the railroad industry and in other rulemakings addressing industry-wide matters. He has also represented clients in matters involving the establishment, construction, operation, and abandonment of rail-related facilities, including common carrier determinations and the scope of common carrier obligations.
Mr. Rosenberg has also represented utilities in disputes and other matters with their fuel and transportation suppliers in court litigation (including bankruptcy), arbitration, and negotiation. He has also been involved in litigation and related matters involving antitrust, including the interplay of antitrust with regulation. His activities have frequently involved the calculation and analysis of damages, application of economic theory, and other technical matters.
Mr. Rosenberg directs the firm’s energy regulatory practice, where he has represented clients before the Federal Energy Regulatory Commission (FERC), as well as various federal and state courts. He has also advised and represented clients before FERC and elsewhere regarding the interplay of state and federal regulation, including the scope of preemption, and such matters as open access, rate design, and cost allocation. Mr. Rosenberg has also represented clients in proceedings involving reliability standards and drafted agreements for the delegation of responsibility for complying with reliability standards.
Mr. Rosenberg has been actively involved in proceedings relating to the California power crisis of 2000-2001, including not only the refund proceedings at FERC, but also appeals and related trial court litigation in federal and state courts.
Mr. Rosenberg also participates in the firm’s legislative practice. After graduating from law school, he served as Legislative Counsel to Congressman Thomas E. Petri (R-Wisc.) for a year.
Mr. Rosenberg's publications include: “Revenue Adequacy” (Association Highlights of the Association of Transportation Law Professionals, Jan.-Feb. 2006); “Break the Bottleneck: Recent Decisions Ensure That Bottleneck Rates Remain a Problem on the Rails” (Legal Times, August 18, 1997) (co-authored with Kelvin J. Dowd); “Who Wins in a Competitive Power Market: Gas?, Coal?, Or Rail and Mining Interests?” (Public Utilities Fortnightly, April 1, 1997); and “Reducing Coal Transportation Costs” (Public Utilities Fortnightly, October 11, 1990).
Mr. Rosenberg is a frequent speaker on energy and transportation matters such as the cost of capital for the railroad industry, coal transportation, the extent of FERC regulation over non-jurisdictional entities, and FERC reliability regulation at such forums as the National Coal Transportation Association, the National Rural Electric Cooperative Association, and the Association of Transportation Law Professionals.
