Mr. LeSeur started at Slover & Loftus as a law clerk in 1977; he became an associate at the firm in 1979; and he joined the firm as a partner in 1985. Over the past thirty years Mr. LeSeur has successfully represented firm clients in a number of different practice areas.
In the administrative law practice area, Mr. LeSeur has been lead counsel for rail shippers in major STB rate cases, including the WFA/Basin Electric case, decided by the STB in February 2009, where the STB awarded the complainant shippers rate relief the STB valued at $350 million and described as "the single largest reduction in rail rates ever awarded by this agency." Mr. LeSeur has also served as lead counsel, and successfully represented firm clients, in administrative adjudications involving fuel surcharges, rail build-outs, rail abandonments and unreasonable rail practices.
In the arbitration practice area, Mr. LeSeur has served as lead counsel for rail shippers, and other users of rail service, in several major arbitrations that have resulted in awards producing substantial economic value to firm clients, including one award valued at over $250 million. These arbitrations have included contract disputes involving price reopeners, price adjustment provisions, fuel surcharges, and undercharge claims.
Mr. LeSeur is actively involved in the firm's appellate litigation practice including, Missouri Mining, Inc. v. ICC, a case where the Eighth Circuit upheld an ICC decision permitting new rail line construction; Burlington Northern v. Public Service Co. of Oklahoma, a case where the Tenth Circuit upheld a coal transportation contract arbitration award in favor of the utility coal shipper; and Association of American Railroads v. STB, a case where the D.C. Circuit upheld changes in the STB's market dominance rules.
Mr. LeSeur regularly represents firm clients in negotiations of rail transportation contracts, coal supply contracts and other commercial agreements. As part of these representations, Mr. LeSeur has counseled clients on all phases of the negotiations, including strategy, contract drafting and obtaining requisite governmental approvals.
Mr. LeSeur is a leader in the firm's legislative practice, including the legislation that created the STB, amendments to the Clean Air Act, and Federal Coal Tax legislation. His legislative practice has included the drafting of legislative language, testifying before Congressional committees and advising clients on legislative strategy.
Mr. LeSeur is a frequent speaker on a variety of topics, including maximum rail rate litigation, construction of rail lines, and Clean Air Act issues impacting coal burning utilities. He is a former Chairman of the Transportation Law Committee of the American Bar Association (Young Lawyers Division).
